These terms are the agreement between you and Naptime.pro. They explain what the software does, what it does not do, and where responsibility sits — which, for the care of children and for meeting licensing rules, sits with the child care provider, not with the app.
By creating an account or using Naptime.pro, you agree to these terms. If you use the app on behalf of a child care program, you confirm you are allowed to agree to these terms for that program.
The app has roles: providers (the program owner or operator), staff, guardians and parents, authorized pickup people, and applicants. What you can see and do depends on your role.
Naptime.pro is software. It is a tool for record-keeping, communication, and payments. It is not a child care provider, it does not supervise or provide care, it is not a licensing or regulatory agency, and it does not give legal, medical, tax, accounting, or compliance advice.
Nothing in the app is a substitute for your legal obligations. That includes the templates and forms, the drill schedule and due dates, ratio and capacity settings, the record lists, the inspection packet, and every reminder or alert we display. They are administrative aids built from what your program enters.
The provider operating the program is solely and fully responsible for complying with every federal, state, and local law, rule, and licensing standard that applies to their program. This includes, without limitation:
The provider must independently confirm that every document, form, template, checklist, schedule, log, letter, count, and generated record in the app satisfies the requirements of their state and locality, and must adapt or replace anything that does not, before relying on it. Templates and forms in the app are samples and starting points — they are not approved, certified, or state-specific legal documents.
Naptime.pro does not review, audit, approve, or certify a provider's records, ratios, drills, documents, or practices, and does not monitor whether a provider is following the law. A due date, count, reminder, or prompt in the app is an administrative convenience calculated from what the provider entered. It is not a compliance determination and it is not a substitute for the provider knowing their own rules.
The provider — and not Naptime.pro or its owners, officers, employees, contractors, or suppliers — is responsible for the care of children, for the accuracy and completeness of every record, for the documents used with families, for obtaining the consents the law requires, and for any consequence of failing to meet a legal duty.
Our responsibility is limited to providing the software described in these terms. We are not responsible for the acts or omissions of any provider, staff member, guardian, authorized pickup person, or applicant.
Give us accurate information, keep your sign-in details and PIN private, and tell your provider immediately if you believe someone else has your access. Providers decide who is on their team, which rooms each staff member can see, and who is allowed on a child's pickup list.
You are responsible for activity that happens through your account. If you are a staff member, your provider can switch off your access at any time.
Guardians are responsible for keeping contact details, custody and release restrictions, and the authorized pickup list accurate and current. A provider may rely on what the app shows them, and a child may be released to a person the guardian has authorized. Authorized pickup people agree to use their PIN only for the children authorized to them and never to share it.
You agree to sign forms and acknowledgements electronically in the app, and you agree that your electronic signature is valid and binding under the federal E-SIGN Act and the Uniform Electronic Transactions Act as adopted in your state. You also agree to receive these records electronically instead of on paper.
Providers must retain the signed records the law requires and give families a copy on request. The app stores the signature image, typed name, timestamp, and technical audit details with the form. Signatures and signed records are not deleted through the app; corrections are added as new entries with an audit trail.
Providers set their own rates, invoices, subsidies, and late fees, and are responsible for their accuracy, for their own tax reporting, and for following any subsidy program or payment-related rules. Families pay the provider directly. Naptime.pro processes the payment and deducts the platform fee set by the provider's plan.
A provider's own Naptime.pro subscription and any free trial are billed by Naptime.pro and can be changed or cancelled from Billing in the app. Payment card details are handled by our payment processor and are not stored by us.
Refunds, credits, and disputes about care charges are between the provider and the family. Subscription charges and platform fees already earned are not refundable except where the law requires it.
The free trial lasts 30 days from the day it starts, and it requires a valid payment method before it begins. Nothing is charged during the trial.
When the trial ends, the card on file is charged automatically for the plan and billing period chosen at sign-up, and then again automatically at the start of every following month or year until the plan is cancelled. Starting a plan authorizes those recurring charges.
A plan can be cancelled at any time, online, in Settings → Billing, and no further charge is made. We send a reminder before the trial ends, a receipt for every charge, and a reminder before an annual plan renews.
Subscription prices are the ones shown on the Pricing & Fees page and at sign-up for the plan chosen. Our fee on payments from families is 2% of each payment while on the free trial or a monthly plan, and 1% on an annual plan, deducted automatically from the payment before it reaches the provider's bank account.
Stripe, our payment processor, charges its own processing fee on each payment — currently 2.9% plus $0.30 on a card, an extra 1.5% on an international card, 0.8% capped at $5.00 on a bank transfer, and a dispute or chargeback fee. Stripe sets those rates, may change them, deducts them from the payout, and they are subject to Stripe's own terms.
Stripe's current rates and the Stripe Connected Account Agreement are linked from our Pricing & Fees page, together with a worked example of what a payment costs.
Subscription charges are not refundable, and there are no partial or prorated refunds — including when a plan is cancelled, when a plan is downgraded, when the app is not used part-way through a period, or when the plan is no longer needed.
When a plan is cancelled, full access continues until the end of the period already paid for, and no further charge is made. We will refund duplicate charges or billing errors we cause, and anything the law requires us to refund.
An upgrade takes effect immediately, and the prorated difference for the rest of the current period is charged at the time of the upgrade. The amount is shown before it is confirmed.
A downgrade takes effect at the start of the next billing period, and no credit or refund is given for the period already paid for. If the program has more enrolled children than the plan being moved to covers, we ask for a plan that fits — nothing stops working while that is decided.
If a charge does not go through, we retry it and email each time it fails. Full access continues for 14 days from the first failure so there is time to update the card.
If payment still has not gone through after that, the app moves to a limited state until the balance is paid: signing in, updating the card, viewing records, and exporting them keep working, while signing children in and out and the family features pause. Nothing is deleted, and everything reopens as soon as payment succeeds.
We may change subscription prices and fee rates. When we do, providers are emailed at least 30 days before the new price applies to their plan, and they can cancel before it takes effect. The price already paid stays for the period already paid for.
The rates in force for our platform fee and for Stripe's processing fees are always published on the Pricing & Fees page.
Providers set their own tuition, fees, and schedules, and are responsible for their own refund policies with families and for collecting what they are owed. Naptime.pro is not a party to the agreement between a provider and a family, and does not decide what is charged, what is refunded, or who is enrolled.
If a provider refunds a payment that was made through the app, the platform fee already taken on that payment is not returned, unless the law or Stripe's rules require it. Disputes between a provider and a family about care, charges, or refunds are theirs to settle.
When a plan ends, the records are kept and there are 90 days of read-only access so they can be exported — licensing records included. Export during that window.
After the read-only window, the program is archived under our retention rules: records stay available on request, and are removed for good only under those rules or when a deletion is confirmed.
Do not use the app to break the law, to harm or endanger a child, to harass or threaten anyone, to upload content you do not have the right to share, to scrape or resell the service, to test or bypass security or the access rules, to attempt to see records that are not yours, or to store information you are not lawfully allowed to hold. Do not share a child's information with anyone who is not authorized to have it.
Providers must obtain and keep evidence of every consent the law requires before entering a child's information or sharing photos of that child, including any COPPA consent that applies to their program and any state licensing requirement. If a parent asks the provider to stop sharing photos of their child or to stop collecting further information, the provider must honour that request.
The records a provider puts into the app are the provider's, and the provider is responsible for them. We host and process that data so the software works, and we may use aggregated, de-identified statistics to operate and improve the platform — never a child's identifiable record for advertising. The software, design, and trademarks belong to us; these terms do not transfer any ownership of them to you.
We work to keep the app running, but we do not promise uninterrupted service. Maintenance, outages at our hosting or messaging providers, and your own device or connection can interrupt it. Do not treat the app as the only copy of a record you are required to keep — export or print what your licensing rules require, and keep your own backups of signed forms.
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent the law allows. We do not warrant that the app will be error-free, that defects will be corrected, or that any form, template, or reminder will satisfy your licensing rules.
To the fullest extent permitted by law, Naptime.pro and its owners, officers, employees, contractors, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, licensing penalties or fines, suspension or loss of license, loss of enrollment, or business interruption, arising out of or related to the app or these terms.
Our total liability for all claims relating to the app is limited to the greater of (a) the amount the provider paid us for the service in the three months before the event giving rise to the claim, or (b) one hundred US dollars. Nothing in these terms limits liability that cannot be limited by law, or our responsibility for our own fraud, gross negligence, or wilful misconduct.
The provider agrees to defend, indemnify, and hold harmless Naptime.pro and its owners, officers, employees, contractors, and suppliers from and against any claim, demand, loss, fine, penalty, liability, or expense (including reasonable legal fees) arising out of or related to: the provider's care of children; the provider's failure to comply with any federal, state, or local law, rule, or licensing standard; the documents, forms, templates, or records the provider uses, adapts, or produces; information the provider enters into the app; the provider's rates, invoices, subsidies, taxes, or employment practices; or any dispute between the provider and a family, staff member, or applicant.
A provider may close their account at any time from Settings. We may suspend or end access if these terms are seriously or repeatedly broken, if the app is used unlawfully, or if suspension is needed to protect children or the service. When an account closes, the provider should export the records their licensing rules require first. The sections on responsibility, records, liability, and indemnity survive the end of these terms.
We may update these terms. The version and the last-updated date at the top of this page change with every version, every published version is kept in the version history below, and material changes are emailed to providers, who are asked to accept the new version the next time they sign in. These terms are governed by the laws of the state in which the provider's program is located, without regard to its conflict-of-law rules, and disputes will be handled by the state or federal courts located in that state, unless the law where you live gives you a right to a different forum.
If any part of these terms is found unenforceable, the rest stays in effect. Together with the Privacy Policy, these terms are the whole agreement between you and us about the app.
Parents and guardians can choose to receive urgent text notices from their child care provider — for example a closure, an early pickup, or an emergency. Opting in happens on the provider's application form, in the enrollment checklist, or in account settings. The consent box is never ticked in advance, and opting in is never a condition of enrollment, of care, or of any purchase.
Reply HELP for help, or reply STOP to opt out at any time.
After STOP, no more texts are sent to that number unless the person replies START or opts in again. Only urgent notices are sent — never marketing or promotional texts — and message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. Full program details are on the text message programme page.
Reach the Naptime.pro team from your account in the app. For anything about a child's records, the care provided, charges between a family and a provider, or licensing, start with the child care provider.
A note for providers
These terms are written to place compliance with federal, state, and local law — including the documents and records you use — on you as the provider, and to limit the app creator's responsibility to providing the software. They are a starting point, not legal advice. Before you publish, replace the placeholders with your business name, address, and contact details, check the sections on record retention, reporting, and privacy against your state's child care licensing rules, and have your own attorney review both this page and your family documents.
Every charge — the plans, our fee on payments from families, and Stripe's processing fees — with a worked example, is on the Pricing & Fees page.
Every published version is kept here, newest first, so you can see when the Terms changed and what changed.
